Ed Malone and Ethel Fitzgerald Malone

In 1996 my husband and I moved to Fond du Lac, Wisconsin a month after we were married in Virginia. Upon hearing the news via my mother, my paternal grandmother wrote me a note that her Great-Aunt lived in the station. So, I wrote a note introducing myself to my Great-Grand Aunt. In it I explained that my grandmother was Kathleen Fitzgerald Kinross and her mother was Mildred Fitzgerald who married Bob Kinross. I received a phone call from Mrs. Malone inviting us over. This began a wonderfully rich, although very short, friendship.

Ethel Fitzgerald Malone was born in 1907 according to her gravestone but I thought she told me 1901. Ed was born in 1903 according to his gravestone. So by 1996, well they were up in years; he was 93 or so and she was about 89 years used. They were full of life, read the papers, had ideas and opinions on everything.

Uncle Ed, as I called him, had learned how to use a computer and had written himself a program to keep up with his statistics. My husband, a computer geek by trade, often tells people to this day that if his 90-year-old Uncle wasn’t timid to learn recent things then they have no excuse. One of Uncle Ed’s expansive interests was baseball statistics. He kept records of all the baseball players and was so meticulous about it that Ethel says he was known for his accuracy and the newspapers would call him if a fact needed to be checked out. Chicago was their team.

Ed also had a love for sailing and art. He was a watercolorist and a few of his things were on the wall. I enjoy he worked for the railroads throughout his working life.

Aunt Ethel worked at Thresher men’s insurance, which is now Society Insurance. She was so spunky and was once a red head. Uncle Ed would say, “When Ethel was upset you could tell there was “fire in the mountain.” “

I asked Ethel once about World War 1. She didn’t seem to remember being too affected by the war itself but she told me that when peace had been announced she and her brother Emmet went to the pasture and rode around the horse hollering “to hell with the Kaiser!” at the top of her lungs. It was hysterical to see this 90-year-old lady tell me this, with her blue eyes twinkling, and her fist over her head.

I asked what she did when World War Two ended. “Oh? ” she said. “We went to church and prayed.” But she says it with a mischievous grin.

She tells me that when she became old enough to go to dances she always arrived with her brother. The girls would invite her to come with them as a group but Ethel disdainfully points out that she wanted to have a good time and dance. Whenever she arrived with her brother, she said hello to his friends and one of them would ask her to dance and she’d expend the whole time dancing. She didn’t see the point in going to the dance with girls.

When Uncle Ed became interested in courting Ethel for marriage, Ethel said she discouraged him. It was during the Great Depression and she wasn’t going to get married to anyone who didn’t have a good job. She was living with her newly married sister, Mildred, my great grandmother, and working as a bookkeeper for Thresher men’s Insurance. She tells of a time she went and bought herself a rather nice dress and saw the doctor’s wife in it and wondered if she had spent too much on herself.

She had wonderful things to say about fashion. She refused to wear pants ever and was appalled at what the girls were wearing to work in the 1990′s. “I wouldn’t got to the grocery store in those clothes!” She said. She taught me that a girl should set aside her gloves on before leaving the house, her mother always said “only the serving girls place their gloves on in the street.”

Ethel and Ed did not have children and lived a comfortable life with tiny extravagance. The did travel to Ireland several times in search of family lineage, and Ethel had copies of marriage, birth and death certificates regarding Fitzgerald’s and Martin’s going back to the 1700′s in Massachusetts. For a time they traveled to Florida on a yearly basis. When they died they purportedly left their estate in wonderful order, medical bills were all paid, and they left a significant amount of money to the church.

Ethel and Ed were wonderful people for myself and my husband to meet. We were young, newly married and far from home. In the Malone’s we found family, history, and life lessons we carry today. I was in Fond du Lac recently and took my children to St. Charles Cemetery to pay a visit to Ethel and Ed. We brought them flowers which would have made Ethel smile. She was always worried there would be no one left to remember her.

There is a mammoth difference between auto insurance and health insurance. This article is an effort to raze the misinformed repeating the analogy between the two as justification for health insurance as Obamacare requires. Now pay attention dammit!

Auto insurance is a lawful requirement IF YOU OWN A CAR OR HAVE A LICENSE TO DRIVE because of two fundamental law-based reasons – the VOLUNTARY engagement in commerce, and the need for the plot to protect the public at large from one’s exercise of that voluntary commerce.

The first is fundamentally obvious. If one is driving a vehicle they had to voluntarily engage in commerce. Unless one built a Fred Flintstone mobile they had to buy the vehicle from someone. That is commerce, thus government can get involved to regulate it. In some states the possession of a license to drive requires one to have auto insurance even if they do not own an auto. For folks who do not drive anything at any time, they can get a site issued ID and there is no insurance requirement. And in many states even if one has a license to drive, unless they own an auto they do not have to be insured. It differs by state.

To attach a finer point on it, what if one drives for a living, a truck or taxicab let’s say, the company provides the insurance, no? So if one does not drive except the company vehicle, they likely are not required by law to have auto insurance, because they have no auto, unless they are in a location that requires insurance to obtain a permit to drive, and that is still to protect the public in case the permit holder drives another private individual’s vehicle.

The second and more salient point is auto insurance is a law because of one’s exhaust in operating the vehicle. A 3000lb car is a deadly weapon so insurance is demanded to protect the innocent from the actions of one’s driving. To demonstrate the idea, if one has an old car, I mean broken-down and not an antique or whatever, they often have no comprehensive coverage to repair their vehicle from damage, but MUST BY LAW have liability insurance to protect others from the potential damage one might do while driving. Is this clear? Understand? It is to protect others from the actions of the individual operating the vehicle.

It is an exercise in public safety.

Health insurance is to protect ME and no one else. If I do not have health insurance, will that cause another person injury (excepting of course potential financial damage due to paying, indirectly, my medical bills)? No, it will not. For example and to further prove the difference, if my car hits you and I am at fault my insurance pays. But if I walk up and punch you in the mouth, do I have insurance coverage to pay your medical bills? No, of course not. I am criminally liable and financially liable for my illegal act, but YOUR insurance would have to pay the medical bill until the courts deal with me and force me to make restitution.

As well, and the real sticking point, is the government forcing one to engage in commerce against their will. If I do not want auto insurance and I do not drive and have a region issued ID but no permit to drive, NO ONE can force me to purchase insurance to drive, legal?

Yet government is forcing EVERYONE to recall health insurance and that is the forcing of one to engage in commerce. That is un-Constitutional. Sorry libs, but it is what it is, and this is proof of why lefties always scream
“the Constitution is a living document.” It’s not. Under our system government cannot force one to engage in commerce.

Now add in the Obamacare requirement that if one DOES NOT purchase health coverage they are fined by law. Again, un-Constitutional to prosecute one for NOT engaging in commerce. Get it?

Auto insurance and health insurance are for two entirely different purposes. Auto insurance is required to protect the public from our exercise of our PRIVILEGE to operate a vehicle on the state roads. If one owns 1000 acres and has a tractor, are they required to have insurance? If they have a “Farm use only” vehicle, even a regular old truck let’s say, as long as the vehicle is only used on the farm, there is NO REQUIREMENT for insurance. As long as the vehicle is never put on a state road the state cannot require ya to insure the vehicle.

See the difference? The state can regulate how THEIR roads are used, but they cannot regulate how one operates their farm vehicle on their own private property. Is this too difficult a concept for some of you to wrap your brains around?

My argument here is a legal one, and not a moral one. That’s because morals are not laws. Don’t chime in bemoan the misery of it all. The law is the law. Yet those who favor Obamacare do not have respect for the law because they have all this misplaced empathy, hence why they will argue “To Hell with the Constitution.” Their moral outrage and empathy supplant their celebrated sense and the damned laws.

So, auto insurance and the STATE requirements therein are vastly different than are any health care mandates that by law force one to engage in commerce and for the FEDERAL GOVERNMENT to fine them if they do not.

Both the forcing of one to select in commerce by law and the prosecution of one who does not are un-Constitutional. And THAT is the difference. Jeez, to hear some people rail on and on without a clue just slays me. How’s bout ya stop your mouth and open the Internet and look it up for yourself. Of course you’ll have to drop the empathy and open your damned mind. I know, I know, too much to hope for from much of that crowd, cause, ya know, “it’s just such a shame some people don’t have health care. It’s their right, ya know!”

No asses, it is NOT a right! Just cause you wish it was and repeat it a million times does not make it true. Don’t take my word for it. How’s bout ya pick up a book?
